Mortgage Foreclosure Defense

RLG represents clients defending against the overreaching efforts of today's lenders engaged in the mortgage foreclosure crisis impacting so many property owners. With over 50% of mortgage loans “under water”, defenses are raised on behalf of property owners designed to defend and preserve the client's rights in the lawsuit. Simultaneously, original closing documents are reviewed for possible federal and/or state law violations by lenders leading up to or at the time of the original closing. Throughout the process, opportunities to modify the loan or short-sale the property are periodically discussed, reviewed and proposed to determine the lender's willingness to negotiate a resolution to the litigation. Ultimately, we will not settle any case that does not truly offer fair and reasonable settlement terms for our client.

Most critically, since short-sales seem to be the predominant purchase and sale transaction in today's real estate marketplace, reviewing and understanding the bank “approvals” received by sellers are more important than ever. (This approval is the key to the short-sale since it is required in order to release the underlying mortgage lien and close the short-sale.) RLG will help you review, understand, and negotiate this process to expose the latent dangers in bank “approvals”. In these times where potential “deficiency judgments” create the biggest long-term danger to sellers, RLG can be your voice and advocate, but most importantly, your counselor in helping overcome the legal risks involved in a short-sale.
